California Docs and Patients Should Join Them NOW!

(Robert F. Kennedy Jr. Esq. for those of you who are reading this from beyond our solar system.) (PIC’s fearless President, Shira Miller MD outside the Courtroon after the AB 2098 hearing. Editor’s note: She seems pleased and confident, and as turns out, for good reason. Thx Shira for backing this.) (The rest of the legal team and our expert, Dr. Sanjay Verma) As most of you know, on January 25th, senior federal district court Judge William B. Shubb granted…

Washington Federal Judge Denies TRO to Stop the Washington Medical Commission’s Prosecutions of Covid Misinformation Soapbox Speech

Washington Federal Judge Denies TRO to Stop the Washington Medical Commission’s Prosecutions of Covid Misinformation Soapbox Speech

On Friday March 17th, a Washington (state) federal judge denied a TRO filed by three physicians who were claiming that the the Washington Medical Commisions (their medical board) violated their federal constitutional and state law rights in filing charges against them for speaking out in public against the mainstream Covid narrative. Here are the complaint, TRO application and the judge’s decision: Complaint(1) TRO Denial of TRO The judge wasn’t buying any of it, but I have to say, I don’t…

Status Report on the Covid Misinformation Situation for California Physicians and other interested parties (in western states)

Status Report on the Covid Misinformation Situation for California Physicians and other interested parties (in western states)

There have been a lot of papers flying around the state in various court cases, so it seemed like a good idea to tell the vaccine-concerned physician and lay community where the law and cases stand. Soapbox Speech Before I get into the AB 2098 lawsuits, let me relate where we are on the pre-AB 2098 soap-box speech Covid misinformation investigations by the medical board which started in late 2021 and early 2022. So far as I can tell, there…

MAJOR UPDATE AND BREAKING NEWS IN THE AB 2098 BATTLE

MAJOR UPDATE AND BREAKING NEWS IN THE AB 2098 BATTLE

As you know, our case, Hoang v. Bonta, together with the related case of Hoeg v. Newsom had some recent success before Judge Schubb, by his enjoining the enforcement of AB 2098 (now section 2270 of the Business and Professional Code). His decision was limited to the parties of the two cases, meaning the five docs in Hoeg, our lead plaintiff Le Trinh Hoang, but also included are all the members of our organizational Plaintiffs, Physicians for Informed Consent and…

AB 2098 hearing held yesterday, no result yet, but we are very, very hopeful

AB 2098 hearing held yesterday, no result yet, but we are very, very hopeful

(Man with shades outside Sacramento Federal Courthouse after oral argument in the challenges to AB 2098) We had the hearing on our challenge (and the companion challenge filed by a high-profile Washington D.C. public interest group) yesterday afternoon. It was a very lively event. And because it was me, there were many lighter moments and even some robust laughter with some back-and-forth banter between us and the judge. Not so much with the Attorney General and the judge. And that…

California Physician Alert: Be Very Careful About What you Say About Covid to New/Prospective Patients

California Physician Alert: Be Very Careful About What you Say About Covid to New/Prospective Patients

As you all know, AB 2098 is, for now, the law of the land in California. Hopefully it won’t be after our preliminary injunction hearing on Monday. I think all physicians should assume that the Cali boards (medical and osteopathic) will try to enforce the law. But there is problem: How are they going to find out who is spreading “Covid misinformation” to their patient? My guess or assumption is that current patients aren’t going to be the ones complaining….

Must See CHD TV on AB 2098

Here is the link to the legal update on CHD’s and PIC’s lawsuit against AB 2098. https://live.childrenshealthdefense.org/chd-tv/shows/good-morning-chd/chd-federal-lawsuit-over-ca-covid-misinformation-bill/ There is an excellent discussion by Dr. Sanjay Verma explaining how often the public health authorities got it wrong during Covid and the lack of science behind the public health decisions we all have been living with for the past three years. And I always have a good time when FG&J get together (Ray Flores, Greg Glaser, and yours truly). (Hopefully, they edited…

Save the Date for the Mother of all AB 2098 First Amendment Hearings

So, here is the latest news. The hearing in our AB 2098 challenge Hoang v. Bonta, AND the hearing on the prior-filed case, Hoeg v. Lawson have both been set for January 23rd at 1:30 PM before Judge William B. Shubb. So far, the judge is holding live hearings, with online zoom viewing for the public, but the live part could change depending on what happens with the trifecta of viruses and hospitalizations. The judge may issue an order from…

No Decision yet on the McDonald AB 2098 case, but methinks the writing is on the wall

No Decision yet on the McDonald AB 2098 case, but methinks the writing is on the wall

Yesterday was the hearing/oral argument in the first challenge to Cali AB2098, the Covid misinformation bill. The case is McDonald v Lawson which is in Federal Court in the Central Disrict of California (Los Angeles). For such a big case, I thought the hearing was not very long and more tellingly, it focused on one issue only, standing, which is the suitability of the plaintiffs to bring the lawsuit. And frankly, I think that says it all. If the judge…
