The Cali AB 2098 Lawsuits So Far

The Cali AB 2098 Lawsuits So Far

As you all know, on September 30th, Governor Newsom signed AB 2098, which created a sort of “new” Covid misinformation/disinformation law. I put “new” in quotes because the Medical Board took the position during the legislative process as well as in response to the first lawsuit challenging the law, that it already had the power to sanction physicians for spreading Covid misinformation to patients under its general powers. I personally think that’s a dubious proposition, but I suppose it does…

Round Two coming up in the AB 2098 Cali. Covid “Misinformation” Wars

Round Two coming up in the AB 2098 Cali. Covid “Misinformation” Wars

As I’ve stated in many of my AB 2098 posts, there will be several lawsuits challenging AB 2098. The first one was filed a couple of days ago. The plaintiffs are a psychiatrist who is already under investigation for public Covid misinformation to the public. The other plaintiff is a well-known physician activist who has a concierge practice in Orange country. I’ve seen the complaint, but I don’t think the preliminary injunction papers have been filed yet. I have been…

Breaking News! You’re not Going to Believe what the Cali. Medical Board is NOT Doing!

Breaking News! You’re not Going to Believe what the Cali. Medical Board is NOT Doing!

As many of you know, I have been hard at work on a big First Amendment case to stop the Cali. Medical Board (and maybe soon other medical boards soon) from investigating physicians for their public criticism of the mainstream Covid narrative. I happen to think that a physician has an unfettered right to express her opinion about matters of public health without the threat of professional discipline. While medical boards might have jurisdiction to oversee the standard of care…

My Interview with Allison Royal on the Mckenzie lawsuit

My Interview with Allison Royal on the Mckenzie lawsuit

Yesterday, I did an interview with now independent journalist Allison Royal on the Mackenzie case. Here is the link. https://rumble.com/v1ec0cn-ca-medical-board-drops-investigation-of-doctor-that-spoke-out-at-school-boa.html I had never heard of her so I dug around the internet and found out that she walks the walk. She had been a tv reporter for a San Diego TV station, and by all accounts a pretty good one. But she had one problem: She didn’t want to get vaccinated and she was the only reporter who wouldn’t take…

Pretty Big Update on Mackenzie vs Cali. Medical Board: Board closes its investigation after we file suit, and we just filed an amended complaint

Pretty Big Update on Mackenzie vs Cali. Medical Board: Board closes its investigation after we file suit, and we just filed an amended complaint

Perhaps by coincidence or lucky timing, six days after we filed the lawsuit against the Cali. Medical Board for investigating Doug Mackenzie for “covid misinformation,” the Board send him a letter saying that it was closing its investigation (which investigation was commenced in December 2021). I figured that would happen. So, today I filed an amended complaint adding a physicians’ group (Physicians for Informed Consent) as a plaintiff, to help rebut the anticipated argument that our lawsuit was moot. Here…

As Expected, AB 2098 Moves on to the Senate Appropriations Committee

As Expected, AB 2098 Moves on to the Senate Appropriations Committee

The hearing before the Senate professions committee (not its actual name) just ended. 8-4 (I assume on party lines) in favor of moving the bill. The bill goes next to the Senate appropriations committee. The bill will surely pass through that committee. I was surprised by a few things: First and foremost, the sponsor, Assemblyman Low showed no great understanding of the bill or the issues. He just kept repeating buzz phrases. Maybe he’s a good legislator, and maybe he’s…

AB 2098 gets amended again, and the very minor protection is gone

AB 2098 gets amended again, and the very minor protection is gone

To recap, AB 2098 is California’s attempt to effectuate the Federation of State Medical Board’s call-to-action to state medical boards to sanction physicians for criticizing the mainstream Covid narrative. The bill passed the Assembly and is now before the Senate. It is scheduled for a hearing on Monday, June 27th. In the last couple of days, I received two notices which raise some questions. First, Monday I received a notice from an activist reminding people that they had until the…

What’s Next for Cali. AB 2098, and What it Means for Docs if it passes

What’s Next for Cali. AB 2098, and What it Means for Docs if it passes

Cali. AB 2098 has now passed the Assembly and is in the Senate for consideration. As a reminder, AB 2098 makes it a board disciplinable offense for physicians to spread “Covid misinformation” to their patients. I think you can assume that questioning the safety and efficacy of the Covid vaccines, and speaking positively about the off-label and conventional medicine rejected pharmaceutical Covid treatments (Ivermectin and HCQ) would also be considered by the Board to be Covid misinformation or disinformation. Questioning…

My Analysis and Opposition to AB 2098 to the Assembly Appropriations Committee

My Analysis and Opposition to AB 2098 to the Assembly Appropriations Committee

For what it’s worth: Here is my letter to the appropriations committee which will be hearing AB 2098, which the bill which tries to sanction California physicians from promoting so-called “covid misinformation.” It seems like a big mess and a waste of time now. “April 29, 2022 To: California Assembly Committee on Appropriations Re: AB 2098, Opposition and Proposed Amendment Dear Committee Members: I am a healthcare attorney with substantial experience in medical board work in California and throughout the…

Digging into the the Recent Possible Future Changes to AB 2098: Color Me Sceptical/AND MY OWN REVISION WHICH FIXES EVERYTHING!

Let me try to set out where we are today, before the hearing on SB 2098 which bill originally made sanctionable physicians who publically spread covid misinformation. The original bill The bill was dropped on February 14th. It created a new form of misconduct that the medical board could prosecute and that being a physician providing information to the public via social media or any other public forum information which the board thought was false or misleading, i.e., contrary to…
