Kenneth Stoller MD v. SF City Attorney et al, pending in the San Francisco Superior Court: The Short Version

Here is a brief summary of Ken Stoller’s lawsuit against the San Francisco City Attorney (SFCA): The SFCA held a press conference announcing that he had issued an administrative subpoena on Dr. Ken Stoller for his medical records all his patients throughout the state for whom he has written a vaccine medical exemption. The basis of the subpoena is an alleged investigation about whether Dr. Stoller’s exemption writing practices is a public nuisance, presumably in light of the uptick in…

One done, 79 to go, and what else is next

Paul just post this as part of a comment about the lawsuit: “Today I discussed this lawsuit with my CA legislator’s staffperson, and provided her office with a copy of the complaint.” Seems like a very, very good idea. I have to believe that there are vaccine concerned in the districts of all of the other 79 Assembly folks. One of the reasons I wrote the complaint the way I did was because any open minded, reasonable person would see…

Press Release: For Immediate Release: Dr. Kenneth Stoller Sues San Francisco City Attorney for Abuse of Power; Lawsuit aims to defend privacy rights for California Patients’ Medical Records and Genetic Information June 4, 2019

Today, Dr. Kenneth Stoller filed a lawsuit against the San Francisco City Attorney Dennis Herrera for abuse of power and abuse of process due to the City Attorney’s illegal attempt to obtain the medical records and genetic information of Dr. Stoller’s vaccine exemption patients. The City Attorney’s subpoena is illegal under state and federal law and represents an attempt to circumvent federal and state constitutional privacy and other protective laws that prevent “government snooping” regarding protected genetic information. There are…

Today, Dr. Kenneth Stoller has filed a lawsuit to stop the San Francisco City Attorney’s attempt to obtain the medical records and genetic information of his vaccine exemption patients. The basis of the City Attorney’s subpoena, which was served and widely reported in the media on May 8th, is a purported public nuisance investigation about Dr. Stoller’s practice of writing medical exemptions for children who do not meet the strict CDC (Centers for Disease Control) vaccine contraindications. here is the…

The Cali. Medical Board is Stuck Between a Rock and a Hard Place on SB 276 (updated with the good news links)

Last week, the Medical Board of California held a multi-location public hearing and comment on SB 276. By accounts, there were many excellent speakers making cogent points against SB 276. The consensus of opinion was that the Board members listened attentively and heard the concerns of the speakers. And that’s a very good thing. The result per a recent press release was that the members of the Medical Board support the concept of the bill but not the particulars, presumably…

And no, being “fragile” or having a vaccine exemption is not being disabled under the ADA

And no, being “fragile” or having a vaccine exemption is not being disabled under the ADA

Ok, so if it’s not medical discrimination, how about discrimination against the disabled under say the American With Disabilities Act? Probably a fairly hard no for almost all of the current exemptees. For starters, if your child got an exemption because of family history, or a genetic test, your child isn’t disabled. Same applies if the exemption was based on a prior AE, unless the AE caused your child to be actually disabled, and I’m guessing that is rare. Here…

Sorry Cali. Vaccine Concerned, but I don’t think “medical discrimination” is a valid basis to challenge SB 276

Sorry Cali. Vaccine Concerned, but I don’t think “medical discrimination” is a valid basis to challenge SB 276

A few of you have suggested something about a class action against a school or someone as medical discrimination if their child’s vaccine exemption application is denied or an existing exemption is revoked. I’ve never heard that kind of thing before, and I doubt it exists in law. But if there’s a case out there in the case books, I’ll take a look at it, but I really doubt there is. Reason being, it is accepted law across the country…

What’s still going to happen if Cali SB 276 becomes law

What’s still going to happen if Cali SB 276 becomes law

I’m getting some requests for information/advice about what happens if SB 276 becomes law. I did a post about it based on the original version of the bill. The only things that have changed regarding current exemptions is 1. the date parents have to submit their child’s medical exemptions has been pushed back from mid 2020 until end of December 2020, and 2. Now, there is no requirement that the department of health look at past exemptions. This meaningless change…

SB 276 new amendment filed. It was a head fake not a curve ball/tactical retreat benefiting Current Exemptees: Sceptics 1, Hypocrite accusers 0, People (like me) who were relieved and grateful 0

As most of you already know, Senator Pan’s amendment was filed yesterday afternoon, May 17th. Here it is. https://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=201920200SB276 Unfortunately, it doesn’t protect the children with current exemptions (or it does, if you’re in the mainstream). Friends and commenters have correctly analyzed the bill. No sense reinventing the wheel on this. Here is some of new bill language, related by one commentator: There is no “grandfathering” in the amended text: (d) If the State Public Health Officer or a local…
