Some further thoughts on the Upcoming Revocation of Medical Exemptions

Some further thoughts on the Upcoming Revocation of Medical Exemptions

I have received some very astute comments in response to my recent post which discussed appealing the revocation of your child’s medical exemption due to the disciplinary action against the ME writing physicians. The information has caused me to rethink what I presented (and didn’t present, for reasons I don’t want to make public) and I want to share some concerns, and give some more details than I had not originally planned on discussing in public. The law seems to…

Is Anything Happening With California Schools Revoking Medical Exemptions from Disciplined Physicians? Yes, and it’s Hail Mary Time! (Updated with New Information

I have been asked about that. For what it’s worth, I have been receiving reports from parents that they are receiving letters from schools indicating that their child’s medical exemption is being revoked as of the coming school year based on the fact that the ME was written by a physician who has been disciplined by the Medical Board. I guess that the overwhelming majority of ME’s issued under SB 277 were issued by physicians who have already been disciplined…

My Crossover Moment Between Stem Cells and the Vaccine Issue, some basic facts about VAERS and maybe an interesting strategic suggestion (so please read this to the end)

My Crossover Moment Between Stem Cells and the Vaccine Issue, some basic facts about VAERS and maybe an interesting strategic suggestion (so please read this to the end)

Although many, many of my posts lately have been about the vaccine issue, I view myself as a health care attorney who focuses on novel and unconventional treatments and technologies. The legal contexts may be different, i.e., medical board work, civil litigation, or federal criminal cases (FDA and health care insurance issues) but the overarching commonality is constant, unconventional health care and ensuring the broadest possible access to it. In my FDA-related work, that basically pits me against the government…

Pfizer Announces that it will Seek Full FDA Approval By the End of the Month, So guess what’s coming?

It is being reported that Pfizer will seek full FDA approval (a biological license) for its COVID vaccine by the end of the month. That’s surprising in terms of timing because it’s still only what, about one year since the first human subject received the shots. That is going to drive anyone with vaccine concerns nuts. But this isn’t a normal clinical trial process, far from it. I don’t know the actual numbers of people in the US who have…

In a Surprise to None, the California University Systems Take the First Step to Mandating the EUA/Investigational COVID Vaccine

In a Surprise to None, the California University Systems Take the First Step to Mandating the EUA/Investigational COVID Vaccine

It is being reported in the media today, April 22, 2021, that California’s state university systems are going to mandate the COVID vaccine. Here is one such article. https://www.wboy.com/news/national/californias-public-universities-to-require-covid-19-vaccine/ The UC system is circulating a draft policy statement to seek input from the community (don’t count on your voice being heard if you are against it). Here is the draft policy statement. review-draft-sars-cov-2-vaccination-program-participation-policy-04212021(1) Me and everyone else with a pulse and an interest in the vaccine issue have known this…

What is the Required Catch-up Vaccine Schedule for the Kids with Revoked Medical Exemptions?

What is the Required Catch-up Vaccine Schedule for the Kids with Revoked Medical Exemptions?

I have been asked this very important question about those families who have no choice but to have their children vaccinated due to the revocation of their child’s medical exemptions due to the disciplinary action of their medical exemption writing physician. The CDC’s ACIP publishes a catch-up schedule, but California has a more specific conditional admittance schedule which is the binding legal authority for admittance into school based on vaccination. Because I am a lawyer, I’ll start with the relevant…

Some perspective on the CDPH’s Upcoming Revocation of Medical Exemptions written by Disciplined Physicians (and some other stuff at the end)

Some perspective on the CDPH’s Upcoming Revocation of Medical Exemptions written by Disciplined Physicians (and some other stuff at the end)

My post yesterday which shared the CDPH communication to the California schools revoking all medical exemptions written by physicians who have been disciplined by the medical board has sparked outrage, confusion, and questions. I think it might be helpful (though regrettably not satisfying) to give you some perspective as someone who has been litigating these issues for the last few years. I think some of the facts you might not know or might have forgotten. 1. You have been living…

California DPH Drops the Hammer on Medical Exemptions written by Disciplined Doctors

I have just learned that the California Department of Public Health has contacted all the state’s school districts and informed them that all medical exemptions written by physicians who have been disciplined by the California Medical or Osteopathic Boards are revoked effective the beginning of the coming school year, 2021-2022 (or September 1, 2021, for child care facilities). Here is what the CDPH sent to the schools. https://drive.google.com/file/d/1WxHhNDtsJGwQ9_YXTCkDkhTT03_Lrdtf/view?fbclid=IwAR1Gz54L6u71w8dJu6kPxYBWjwTJuDDpKMjuB6geY_p0vaiQGclVLXVAHfE In addition, CDPH’s notice attached/contained a link to a 92-page list of…

Final Hearing Date on Ken Stoller’s Writ Set for July 23rd

Final Hearing Date on Ken Stoller’s Writ Set for July 23rd

We took the first available hearing date for the actual hearing on Ken’s Stoller’s writ of administrative mandate, and the hearing will be on Friday, July 23rd at 10:00 AM. Usually, on these final writ decisions, the judge will issue a tentative decision, the day before the hearing, the loser gets to try to convince the judge why he’s wrong. The judge did issue a new decision on the stay but he didn’t change his mind. Here is the final…

Stoller Hearing Held, Judge to Issue an Amended Ruling (but don’t get your hopes up)

Stoller Hearing Held, Judge to Issue an Amended Ruling (but don’t get your hopes up)

We had the hearing in Ken Stoller’s stay application which started a few minutes late. I don’t think any of you saw it because the instructions changed. It was held in zoom department 1 and not department 17 which is the judge’s regular part. It was a very spirited discussion between me and the judge. He is a very smart fellow but conventional and believes he has a very limited role of review on these administrative mandates. I started by…
