I just filed a lawsuit on behalf of Dr. Samara Cardenas, a pediatrician who used her brain, and then lost her Medicaid practice because of it.

Here is the short of it:

Even after the pandemic ended, and even after Omicron turned COVID into a glorified head cold for healthy kids, the CDC is still pushing COVID shots for every Medicaid child six months and up. No risk assessment, no clinical benefit required — just line ‘em up and jab ‘em.

Dr. Cardenas said no thanks. She refused to give the shot (which is still investigational for kids up to 12) to healthy Medicaid kids with virtually no COVID risk. Her reward?

The CDC’s Vaccine For Children (VFC) program cut off her vaccine supply.

CalOptima (the Orange Country Medicaid provider) then dropped her Medicaid contract.

She lost all 1900 of her patients and her practice.

We’re asking the court to do what the CDC won’t: apply some basic science, some basic ethics, and a little common sense. We’re challenging the CDC’s zombie vaccination policy under the Administrative Procedure Act, and we’re raising constitutional claims for unequal treatment of Medicaid kids and interference with doctors’ professional judgment.

Oh, and while we’re at it, we’re shining a light on ACIP — the CDC’s heretofore cozy little advisory committee where conflict waivers grow like mushrooms, and where nuance goes to die.
